Protection of your personal data in accordance with the FADP

This privacy policy informs you of how PBM Avocats collects, uses and protects your personal data when you use our website or contact us. It is established in accordance with the Federal Act on Data Protection (FADP), in its revised version in force since 1 September 2023.

Data Collected

We collect only the personal data that is necessary for us to respond to your enquiries or ensure the proper functioning of our website. This data may include:

  • Via the contact form: first name and surname, email address, telephone number (optional), subject of the enquiry and message content.
  • Via website browsing: technical data such as IP address, browser type, pages visited and duration of visit, collected for anonymous statistical purposes.

We do not collect special categories of sensitive data within the meaning of art. 5 let. c FADP, unless you voluntarily transmit such data to us in the course of contacting us.

Purposes of Processing

Your personal data is processed for the following purposes:

  • Responding to your contact or appointment request.
  • Managing the pre-contractual or contractual relationship with you.
  • Complying with our legal and professional obligations as lawyers.
  • Improving the quality and functioning of our website.

Your data is not used for direct marketing purposes without your prior consent.

Legal Basis for Processing

In accordance with the revised FADP, the processing of your data is based on the following legal bases:

  • Performance of a contract or pre-contractual measures (art. 31 para. 2 let. a FADP): when you contact us to obtain legal advice or make an appointment.
  • Legitimate interest (art. 31 para. 1 FADP): for the improvement of our website and IT security, to the extent that your fundamental rights do not prevail over this interest.
  • Consent (art. 31 para. 2 let. b FADP): when you tick the acceptance box for the processing of your data in our contact form.
  • Legal obligation: when the law requires us to process certain data (notably within the framework of our due diligence obligations).

Data Retention

Your personal data is retained for the period strictly necessary for the purposes for which it was collected, and at most for:

  • 10 years from the end of the mandate relationship, in accordance with the limitation periods of Swiss contract law (CO).
  • 12 months for data resulting from simple contact requests without follow-up.

Upon expiry of these periods, your data is deleted or irreversibly anonymised.

Recipients of Data

Your personal data is processed only by authorised PBM Avocats staff. It is not sold or transferred to third parties for commercial purposes. We may use technical service providers (hosting, messaging) acting as data processors, contractually bound to guarantee adequate protection of your data.

We do not transfer your data to third countries without an adequate level of protection within the meaning of the FADP, except where appropriate safeguards are in place.

Your Rights

In accordance with the revised FADP, you have the following rights regarding your personal data:

  • Right of access (art. 25 FADP): you may request confirmation that data concerning you is being processed and obtain a copy.
  • Right to rectification (art. 32 FADP): you may request the correction of inaccurate or incomplete data.
  • Right to erasure (art. 32 FADP): you may request the deletion of your data, subject to legal retention obligations.
  • Right to restriction of processing: you may request the restriction of the processing of your data in certain circumstances.
  • Right to data portability (art. 28 FADP): you may request the transmission of your data in a structured, machine-readable format.
  • Right to object: you may object to the processing of your data based on legitimate interest, for reasons relating to your particular situation.
  • Right to withdraw consent: where processing is based on your consent, you may withdraw it at any time, without affecting the lawfulness of processing prior to withdrawal.

To exercise any of these rights, please send us a written request by email or post to the address indicated below. We will process your request within 30 days.

PBM Avocats implements appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, destruction or disclosure. Our website uses HTTPS protocol to encrypt data exchanges.
